All products/services and information displayed on Picola Vastra Bhandar constitute an "invitation to offer." Your order for purchase constitutes your "offer," which shall be subject to the terms and conditions as listed below. Picola Vastra Bhandar reserves the right to accept or reject your offer. If you have supplied us with a valid email address, we will notify you by email to confirm receipt of your order and email you again to confirm details and process the order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. No act or omission of Picola Vastra Bhandar prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer.

Eligibility for Membership

If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement.

Except where additional terms and conditions are provided for specific products, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. Account and Registration Obligations

Pricing Information

While Picola Vastra Bhandar strives to provide accurate product and pricing information, errors in pricing or typographical mistakes may occur. Picola Vastra Bhandar cannot confirm the price of a product until after you place your order. If a product is listed at an incorrect price or with incorrect information due to an error in pricing or product details, Picola Vastra Bhandar reserves the right, at its sole discretion, to refuse or cancel any orders placed for that product unless the product has already been dispatched.

In such cases, Picola Vastra Bhandar may either contact you for further instructions or cancel your order and notify you of the cancellation. If your order has not been dispatched, it will not be deemed accepted, and we retain the right to modify the price of the product. In this scenario, we will contact you using the email address provided during registration or notify you of the cancellation.

If Picola Vastra Bhandar accepts your order, the payment will be processed, and you will be notified via email. The payment may be processed before dispatch of the ordered product. If we cancel your order after processing the payment, the said amount will be reversed back to your original payment method.

We strive to offer the best prices. However, online prices may sometimes differ from in-store prices. Prices and availability are subject to change without prior notice.

Cancellation by Picola Vastra Bhandar

Please note that certain orders may need to be canceled, and we reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Situations that may lead to cancellation include but are not limited to:

  • Limited quantities available for purchase.
  • Inaccuracies or errors in product or pricing information.
  • Issues identified by our credit and fraud prevention department.

We may require additional verification or information before accepting your order. If your order or any part of it is canceled, or if additional information is needed, we will contact you. If your order is canceled after your payment has been processed, the said amount will be reversed back to your original payment method.

Picola Vastra Bhandar reserves the right to recover the cost of goods, collection charges, and legal fees from individuals using the Site fraudulently. As a merchant, Picola Vastra Bhandar shall not be liable for any loss or damage arising directly or indirectly due to the decline of authorization for any transaction, on account of the cardholder exceeding their preset limit as agreed with the acquiring bank.

Electronic Communications

Governing Law and Jurisdiction

This User Agreement shall be governed and construed in accordance with the laws of India. The courts at Delhi shall have exclusive jurisdiction over any disputes arising out of this agreement.

Any disputes or differences, including interpretation of this User Agreement, shall be referred to an independent arbitrator appointed by Picola Vastra Bhandar. The arbitrator's decision shall be final and binding on both parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration proceedings will take place in Delhi, and the High Court of Judicature at Delhi shall have jurisdiction.

Reviews, Feedback, and Submissions

All reviews, comments, feedback, suggestions, ideas, and other submissions disclosed, submitted, or offered to Picola Vastra BhandarĀ on or through this Site or otherwise in connection with your use of the Site (collectively, the "Comments") shall remain the sole property of Picola Vastra Bhandar. This also includes late delivery caused by any such event.

You agree to defend, indemnify, and hold harmless Picola Vastra Bhandar (Picola India Private Limited), its employees, directors, agents, and their successors, in the event that your order, once dispatched from our warehouse/store, is misplaced, damaged, or exchanged during shipping. In such cases, the shipping partner will be held accountable.

Termination

This User Agreement will remain in effect unless terminated by either you or Picola Vastra Bhandar. You may terminate this agreement at any time by discontinuing use of the Site. Picola Vastra BhandarĀ may terminate this agreement immediately without notice, denying you access to the Site. Such termination will not impose any liability on Picola Vastra Bhandar. Upon termination of this User Agreement, you must immediately destroy all materials obtained from the Site and cease further use of the Site. However, termination will not affect your obligation to pay for any products already ordered, nor will it affect any liabilities incurred during the term of the agreement.

Limitation of Liability and Disclaimers
